SASH DEVELOPMENTS CUSTOMER TERMS & CONDITIONS
1. Application of Terms
1.1 These Terms and Conditions (“the Conditions”) apply to all goods and services supplied by Sash Development Ltd (“we”, “us”, or “our”). By accepting our quotation, you agree to be bound by these Conditions.
1.2 Any variation to these Conditions will only apply if agreed in writing by us and confirmed via email or through an authorised electronic acceptance link.
1.3 A binding contract will only be formed once you have accepted our quotation in writing or through the provided link, and we have acknowledged that acceptance.
2. Quotations and Orders
2.1 Our quotations are valid for the period clearly stated on the quotation document. If no period is stated, the quotation will remain valid for 30 days from the date issued.
2.2 It is your responsibility to check the accuracy of the quotation, including details of products and installation services. Any corrections or changes must be communicated in writing to info@sashdevelopment.co.uk or submitted via the comments section on the quotation email.
2.3 We reserve the right to make technical improvements or minor changes to materials or methods, provided they do not significantly impact the aesthetic or performance of the installation.
2.4 If delays are caused by your failure to provide access, site readiness, or cooperation, we reserve the right to charge additional labour costs at a rate of £500 per day. We carry out installations in all weather unless conditions make it unsafe.
2.5 Payment terms specific to your project are detailed at the bottom of your quotation and form part of this agreement.
3. Survey and Property Inspection
3.1 If a site survey is carried out, it will be arranged within 14 days of your acceptance of the quotation, subject to mutual availability.
3.2 Our survey is non-invasive and limited to assessing the installation feasibility of sash or casement window products. It does not constitute a structural survey.
3.3 Our pricing assumes the property is structurally sound. If the survey reveals unforeseen complications (e.g., unstable brickwork, hidden steelwork), we may revise the quotation or cancel the order. You will be informed in writing. Should you choose to cancel due to a revised price, any deposit paid will be fully refunded.
3.4 If issues arise during installation that could not have been reasonably identified during the survey, we may issue a supplementary quotation. If you cancel at that point, you remain liable for any work already completed or goods manufactured.
4. Cancellation Policy
4.1 You may cancel your order within 7 days of acceptance by providing written notice. Any deposit paid will be refunded in full.
4.2 Cancellations beyond the 7-day window require our written consent. You may be charged for materials, labour, and loss of profit. We reserve the right to retain all or part of your deposit to cover such costs.
4.3 Where works are delivered in stages or phases, each shall be treated as an individual contract. Cancelling one phase does not entitle you to cancel any others.
5. Pricing and Payment
5.1 The agreed price and payment milestones are listed on your quotation. Scaffolding, if required, is charged separately unless otherwise stated.
5.2 All discounts or promotions are valid at the point of signing. Retrospective discounts will not be applied if new offers are introduced after acceptance.
5.3 Final payment is due upon completion of installation. In phased projects, each phase is invoiced and payable separately.
5.4 We accept payment by bank transfer, credit/debit card, cheque (payable to Sash Development Ltd), or cash. Cash payments over £5,000 are not accepted.
5.5 Failure to pay any amount on time may result in:
Suspension of works or cancellation of the contract.
Interest being charged daily at 3% above Barclays Bank’s base rate.
6. Delivery and Site Access
6.1 Delivery and installation dates are estimates. We are not liable for delays unless caused by our negligence.
6.2 Once you are notified the goods are ready, access must be granted within 30 days. Failure to do so will result in full payment being due and storage charges may apply.
6.3 You are responsible for removing curtains, blinds, alarms, furnishings, and flooring in affected areas. If not done, additional labour charges may apply.
6.4 By accepting our quotation, you authorise our installers to move minor items to facilitate the work at your own risk.
6.5 If scaffolding is required, the cost is your responsibility unless stated otherwise in writing.
7. Ownership and Risk
7.1 All risk associated with the goods transfers to you upon delivery or installation.
7.2 Ownership of goods remains with us until full payment has been received.
7.3 Any warranty or guarantee issued becomes valid only after full payment has been made.
8. Product Specification and Finishes
8.1 All installations follow our standard sash window manufacturing specifications unless otherwise stated.
8.2 We do not undertake painting or decorating of window frames, architraves, or interior trim unless included in your quotation.
8.3 It is your responsibility to ensure the property is free from structural issues or other defects that could impact the installation.
9. Liability
9.1 Our liability is limited to the cost of goods and services supplied under this contract and any reasonable direct costs arising from our negligence.
9.2 We do not accept liability for:
Loss of profits, business, or revenue.
Indirect or unforeseeable losses.
9.3 These limitations do not affect your statutory rights or our liability for death or personal injury resulting from our negligence.
10. Customer Responsibilities
10.1 You agree to:
Comply with all relevant health and safety guidance during installation.
Provide access to water and toilet facilities for our installation team.
Secure all necessary planning permissions, listed building consents, or building regulation approvals.
Failure to obtain relevant permissions does not release you from your payment obligations.
11. Delays Beyond Our Control (Force Majeure)
We will not be liable for any delay or failure resulting from events beyond our reasonable control, including (but not limited to):
natural disasters, pandemics, strikes, supply chain issues, transport delays, or adverse weather.
If a delay lasts more than 60 days, either party may cancel the contract without penalty.
